Korrruption inom EU?

“According to reports from a French embassy seminar in Berlin, German
MEP Ruth Hieronymi said that the key “co-operation” amendment to
the Universal Access directive (Harbour report) in the Telecoms
Package WAS intended to provide the basis for graduated response /
3-strikes in EU law”

“She was referring to Amendment 112 of the Harbour report (Article 33
(2a) which specifies that regulators shall promote “co-operation”
between right-holders and Internet Service Provides. She is reported
to have argued that Amendment 112 provides the basis for Olivennes
measures in European law.”

“Frau Hieronymi’s comments are interesting, because this is the first
public admission that the attempt to insert graduated response and
copyright enforcment measures into the Harbour report was deliberate.
It casts serious doubt over claims by certain of her colleagues,
notably Malcolm Harbour, the rapporteur for the directive, that there
was nothing about copyright enforcement or graduated response in his
report.”

Det här är samma hållning som svenska reppen hade på Fjellners
seminarium. Dom trodde inte att det fanns nån renforslösning i
direktivet, och Hökmark påstod på sin blogg att alla såna förslag hade
försvunnit i Seine i Juli:

Så är alltså inte fallet enligt Hieronimy (för övrigt rapportör för
AVMSD). Och vad värre är, Sveriges representanter i rådsarbetsgruppen
har inte sagt flaska om 112:an.

Det har däremot andra länder gjort: “[38] DE, IE, UK and AT have a
reserve on this paragraph and would favour the replacement of “shall”
by “may”. HU has a scrutiny reserve.”. Se nedan:

Consultation with interested parties
2a. Without prejudice to national rules in conformity with
Community law promoting
cultural and media policy objectives, such as cultural and linguistic
diversity and media
pluralism, national regulatory authorities and other relevant
authorities shall [38] as far as
appropriate promote cooperation between undertakings providing
electronic communications
networks and/or services and the sectors interested in the promotion
of lawful content in
electronic communication networks and services. That co-operation may
also include
coordination of the public interest information to be made available
under Article 21(4a) and
Article 20(2).”

Jag fattar ingenting. Vill regeringen ha en renforslösning iallafall?
Varför reserverar man sig inte?

Tillsammans med utebliven kritik i rådsarbetguppen ovan och Hökmarks
försvunna ändringsförslag framstår hela den här soppan alltmer
osmaklig:
